Terms of Service

1. Acceptance of Terms
By accessing or using Hype (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform.
2. Description of Service
Hype is a three-sided marketplace connecting Participants, Event Organizers, and Timing Partners for fitness events in Zimbabwe. The Platform facilitates event discovery, registration, payment processing, tag-based race timing integration, leaderboards, and a points and rewards system.
3. User Accounts
You must create an account to register for events or use certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate, current, and complete information.
4. Participant Terms
When you register for an event, you enter into a contract with the Event Organizer. Hype processes payments and provides the registration platform but is not the event organizer. Refund and cancellation policies are set by each organizer and displayed at the time of registration.
By registering for an event, you acknowledge the inherent risks of physical activity and agree to participate at your own risk. You should consult a medical professional before participating in any fitness event.
5. Organizer Terms
Event Organizers are responsible for creating accurate event listings, managing registrations, and fulfilling the event as described. Organizers agree to comply with all applicable laws and regulations in Zimbabwe.
6. Timing Partner Terms
Timing Partners agree to provide accurate timing data. Hype provides the platform for tag code linking and results display but does not own or operate timing hardware.
7. Payments & Fees
All payments are processed through third-party payment providers (Paynow for EcoCash, OneMoney, Zimswitch and Stripe for USD cards). Hype charges a service fee on transactions, which is disclosed at the time of payment. Refunds are subject to the event organizer's policy.
8. Points & Rewards
Points earned are non-transferable and have no cash value. Points are redeemable as discounts on future registrations at the rate specified on the Platform. Hype reserves the right to modify the points system with reasonable notice.
9. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose
- Create multiple accounts to abuse the points system
- Submit false or misleading information
- Interfere with the proper functioning of the Platform
- Attempt to access another user's account
10. Limitation of Liability
To the maximum extent permitted by law, Hype shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Hype's total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or through the Platform. Continued use after changes take effect constitutes acceptance of the new Terms.
